History of betting and online sports betting in NY
All the way back in 2009/10 the first attempts to legalise sports betting in New York were made. Whilst the bill stalled, another attempt was made by Sen. Adams (who was responsible for the first bill as well) in 2011/12.
It was in 2013 that voters finally got a change to approve casino expansion, which included sports betting as well. In the next five years, four casinos were built. They were all permitted to offer in-person sports betting as well.
In 2015/16, efforts were made to expand sports betting to horse tracks and OTBs. They made little headway, however, and stalled out in the Judiciary Committees of each chamber.
Simultaneously, legislation for daily fantasy sports was considered, a matter which was referred to Attorney General Eric Schneiderman. Contrary to expectations, the AG considered DFS a sports betting activity and ordered FanDuel and DraftKings to cease operations in NY. Ultimately, a fantasy sports law was passed in 2016, however.
Despite all sports betting legalisation efforts in NY, PASPA was still the law of the land. So, whilst sports betting was technically already legal in New York, the existence of PASPA meant that it was not possible to actually offer it.
In 2018, PASPA was finally repealed, however. And after several more bills were introduced to regulate sports betting properly in NY, everything was in place for the first sports bet to be taken at retail locations (namely the casinos in the state) in November 2019.
At that time, mobile betting was not yet legal, and the Covid-19 pandemic became the main focus for the NY government.
It is well-known that New York City was hit especially hard by the first wave in the pandemic, which prompted Governor Cuomo to seek alternative revenue streams for the state budget. This also included online and mobile betting.
The threshold to enter the mobile gambling market in NY was set very high, however, as Governor Cuomo’s main motivation was to bolster the state budget. As such, only a limited number of operators received approval (currently 9), and the tax rate is extremely high at 51%.
